These Terms of Service ("Terms") govern your use of SwiftSearch, a desktop application for macOS ("Service" or "App") operated by Spring Arc LLC ("we," "us," or "our").

By downloading, installing, or using SwiftSearch, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access or use the Service.

1. License Grant

1.1 License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use SwiftSearch on your macOS devices for your personal or business use.

1.2 License Restrictions

• Copy, modify, or create derivative works based on SwiftSearch
• Distribute, transfer, sublicense, lease, lend, or rent SwiftSearch to any third party
• Reverse engineer, disassemble, or decompile SwiftSearch
• Make functionality of SwiftSearch available to multiple users through any means
• Remove or alter any proprietary notices or labels on SwiftSearch

2. Purchase and Trial

2.1 Free Trial

SwiftSearch offers a 5-day free trial with full functionality. The trial begins when you first launch the application. No payment information is required for the trial.

2.2 Purchase

After the trial period, continued use of SwiftSearch requires a one-time purchase of $9.99 USD through the Mac App Store. This purchase:

• Grants you a perpetual license to use the current version
• Includes all minor updates and bug fixes
• Is tied to your Apple ID for easy restoration
• Can be used on all your personal macOS devices with the same Apple ID

2.3 Refund Policy

All purchases are handled through Apple's App Store. Refund requests must be submitted through Apple according to their refund policy. We do not have access to process refunds directly.

3. Acceptable Use

3.1 Permitted Use

You may use SwiftSearch to:

• Index and search files on your personal or work computer
• Organize and locate your documents and files
• Improve your productivity and file management

3.2 Prohibited Use

You may NOT use SwiftSearch to:

• Index or search files you don't have permission to access
• Circumvent any security measures on your system
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to hack, modify, or tamper with the app's functionality

5. Intellectual Property

5.1 Ownership

SwiftSearch, including all content, features, and functionality, is owned by Spring Arc LLC and is protected by international copyright, trademark, and other intellectual property laws.

6. Disclaimers

6.1 "As Is" Service

SwiftSearch is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability

• Non-infringement
• Accuracy or reliability of results

6.2 No Guarantee

We do not guarantee that:

• SwiftSearch will meet all your requirements
• The service will be uninterrupted or error-free
• All files on your system will be successfully indexed
• The app will be compatible with all future macOS versions

7. Limitation of Liability

To the maximum extent permitted by law, Spring Arc LLC shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use SwiftSearch
• Any unauthorized access to or alteration of your data

In no event shall our total liability exceed the amount you paid for SwiftSearch.

9. Termination

9.1 Termination by You

You may stop using SwiftSearch at any time by uninstalling the application from your device.

9.2 Termination by Us

We reserve the right to terminate or suspend your license to use SwiftSearch immediately, without prior notice, for any breach of these Terms.

9.3 Effect of Termination

Upon termination, your right to use SwiftSearch will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

10. Updates and Changes

10.1 App Updates

We may release updates to improve, enhance, or fix SwiftSearch. Minor updates are included with your purchase. Major version upgrades may require additional purchase.

10.2 Terms Updates

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of SwiftSearch after changes constitutes acceptance of the modified Terms.

11. General Provisions

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

These Terms constitute the entire agreement between you and Spring Arc LLC regarding SwiftSearch and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

11.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
